Hi Brendan is a wheelchair user based in Co. Clare…. He has 2 very bad ankles and feet, after 23 operations in his feet throughout his 35 years He ended up in a motorised wheelchair since 2010….. He really need a wheelchair accessible van as his chair doesn’t fit in any ordinary car, he is missing a lot of hospital appointments and can’t get to any social occasions or outings….  He is not looking for anything new or fancy, just needs it to be automatic, and have a lift or ramp at the back of the vehicle to get in to the vehicle…..

Gardaí must hand over all personal emails and notes about Sgt McCabe !!

Garda Headquarters has directed officers of all ranks to scrutinise their personal email accounts, handwritten notes and laptops for any material relating to Garda whistleblower Sergeant Maurice McCabe !!

In an unprecedented move, an assistant commissioner has been appointed to oversee the collation of potentially reams of electronic and written data from gardaí that will then be forwarded to the Disclosures Tribunal !!
In a memo sent to all Garda divisions, seen by the Irish Independent, Garda management laid down the diktat ahead of the next phase of the tribunal, which is examining an alleged smear campaign against Sgt McCabe !!
The blanket search even includes emails sent from officers’ own personal Gmail accounts !!
“Members using Gmail accounts to send and receive work-related emails are also requested to check emails and attachments relevant to the terms of reference and disclose same,” the memo from Garda Headquarters stated !! 
The memo tells all officers they must hand over:
 • Minutes and briefing documents from internal meetings held between July 1, 2012 until May 31, 2014;

 • Any handwritten notes including diary, journal and scrapbook entries;

 • Data on shared drives, official laptops and desktops;

 • Relevant details on Garda diaries.
The news of the major fishing expedition is believed to stem from previous criticism levelled at management by whistleblower Keith Harrison !!
During recent hearings before Judge Charleton, lawyers for the Donegal-based garda said they had sought full disclosure of documents, both written and electronic, but that not all of this data was provided !!
The tribunal also heard submissions from Mr Harrison’s legal team that further searches of documents should be carried out as a matter of necessity after new files were found !!
One of the documents discovered, minutes of a monthly Garda regional management meeting on November 5, 2013, included a single line that Chief Superintendent in Donegal Terry McGinn “updated the meeting on the investigation into Garda Harrison” !!
This stems from a statement given to gardaí in October 2013 by Gda Harrison’s partner Marisa Simms !!
Failing

It led to a Garda referral to the HSE over child welfare issues. The case was closed in March 2014, with the HSE saying there was no cause for concern !!
Gda Harrison is taking separate High Court action against the Garda Commissioner for breaching a court order !!
Former commissioner Nóirín O’Sullivan was accused of failing to fulfil an order to furnish Gda Harrison with the full Garda file in relation to a personal injury claim !! 
Acting Garda Commissioner Dónall Ó Cualáin may be forced to appear in court to defend the claim !!

An Garda Síochána refuse to disclose how many officers have a criminal conviction !!

Calls have been made for greater transparency from the Gardaí after the force refused to disclose how many of its officers hold a criminal conviction. !! 
The organisation said the information was “personal” and that it would not be in the public interest to disclose it. !!
An Garda Síochána were asked, under the Freedom of Information Act, for the number of gardaí who have been convicted of a crime since 2016, as well as details of the crimes and disciplinary action taken. !!
An Garda Síochána, however, has refused to provide the information, leading to demands from a member of the Oireachtas Justice Committee for greater transparency from the force. !!
Fianna Fáil’s Jack Chambers said there must be openness and transparency within the force. !!
“The public has a right to know how many gardaí have criminal convictions.

“It is about being open and transparent. As long as the information is disclosed carefully there should be no reason for it to be withheld,” said Mr Chambers. !!
He added: “There should be a transparent release of figures like this, just as there is from other police forces. !!
“I think it is important that as the pace of reform continues within the organisation that there is openness and transparency.” !!
Responding to the request the Gardaí said that a search was conducted in the disciplinary section of human resources to identify the records sought. !!
Upon reviewing the records however, it was deemed to be “personal information” and should not therefore be disclosed. !!
The force added that “the public interest in preserving the personal information and the reasonable expectation that information can be maintained in a confidential manner by An Garda Síochána in the context of its disciplinary proceedings outweighs the public interest which would be served were the records released.” !!
It also claimed that to disclose the information would “constitute a breach of a duty of confidence” and added “it would be unconscionable for this organisation, engaged in processes involved in alleged breaches of discipline, not to treat the information relating to the process as confidential”. !!

The Commission on the Future of Policing in Ireland has told the Minister for Justice it would be “a serious mistake” to appoint a new garda commissioner until it has completed its work. !!

Minister urged not to rush appointment of garda commissioner !!
The Commission on the Future of Policing in Ireland has told the Minister for Justice it would be “a serious mistake” to appoint a new garda commissioner until it has completed its work. !!
The commission is due to produce its final report on the transformation of policing by September 2018. !!
In a letter to Charlie Flanagan released today, Chairperson Kathleen O’Toole said the commission’s recommendations will affect the future role and responsibilities of any new garda commissioner, and the management structure of An Garda Síochána. !!
She said the commission’s work has so far identified the need for significant changes, including legislation. !!
Ms O’Toole also said it would not be reasonable to expect credible candidates to come forward in the absence of clarity as to what the job would entail. !!
The commission has also pointed out that the key problem in An Garda Síochána is the capacity to effect change in the organisation, and that technical assistance and support needs to be provided to Acting Garda Commissioner Dónall Ó Cualáin as a matter of urgency. !!

Man injured in 2012 shooting of Alan Ryan takes legal action against Gardaí !! 

A MAN WHO was shot and seriously injured in the 2012 attack on Real IRA leader Alan Ryan is pursuing legal action against An Garda Síochána in relation to developments after the incident. !!

Proceedings were issued in the High Court on 24 July 2017. !!
Aaron Nealis was left disabled after the shooting incident in Dublin on 3 September 2012 in which Ryan was killed. While in hospital receiving treatment, the Sligo man was told by gardaí that his life was also under threat and was formally served with a Garda Information Message (GIM). !!
Nealis is now alleging that criminal gangs “were conspiring to have him killed”. !!
He says he made a number of submissions to Gsoc and met with senior gardaí in 2015. He is suing the gardaí for alleged misfeasance in public office. !!
Recently, Nealis says he’s been made aware of threats to him and his family’s lives from “criminal elements”. Solicitors for Nealis say they have yet to receive a “meaningful response” on their client’s safety from gardaí. !!
In a statement, they said: 

“In light of these circumstances we have been instructed to issue High Court proceedings in an attempt to expose the flaws of Gardaí.” !!
A spokesperson for An Garda Síochána told TheJournal.ie that ”as legal proceedings are pending it would not be appropriate for us to comment”. A spokesperson for Gsoc said, ”As it appears that this matter is to go before the courts, it would be inappropriate for GSOC to comment.” !!

Garda Keith Harrison first raised his suspicion that a garda was involved in the distribution of drugs in Athlone in November 2008 but he claims, in a complaint to GSOC and in his statement to the Disclosures Tribunal, that nothing happened on foot of making his suspicions known. !!
Garda Harrison later arrested this same garda for drink-driving in June 2009.

Garda Nicky Keogh then made a formal complaint to the then Confidential Recipient Judge Pat McMahon about the same garda and the sale of heroin in Athlone in May 2014. !!
His complaint was investigated by then Assistant Commissioner Donal Ó Cualáin.

In October 2015, Garda Keogh made a complaint to GSOC regarding the manner in which the then Assistant Commissioner Dónal Ó Cualáin was carrying out his investigation into the alleged involvement of a garda into heroin dealing with Garda Keogh alleging that there appeared to be a cover-up. !!
Later that month, Mr Ó Cualáin was promoted to Deputy Commissioner.

A GSOC report into their investigation of Garda Keogh’s complaint has yet to be released. !!
On May 25 in 2016, following the publication of the report of the O’Higgins Commission of Investigation, which investigated complaints of Garda misconduct in Cavan/Monaghan by Sgt Maurice McCabe, TDs gave statements in respect of the report. !!
During his speech in the Dail, Mick Wallace, Independents 4 Change TD, said:

“In the past two years myself and Deputy Clare Daly have raised issues 18 times about how the Department and the Commissioner have dealt with whistleblowers. !!
Garda Nicky Keogh wrote to the Minister [Frances Fitzgerald] last week. He made allegations on May 8, 2014 to the confidential recipient, Judge Pat McMahon. After that, he said he was subject to five internal investigations and relentless harassment. !!
He said he has been driven out and has been out sick since December 26. He also says he has got no protection. The Minister will know this from the letter she received. !!
His letter went on to say that further to his letter dated July 25, 2015, he had made a protected disclosure to GSOC in respect of a flawed Garda criminal investigation into a conspiracy to supply heroin involving a member of An Garda Síochána in contravention of section 21 of the Misuse of Drugs Act 1977. !!
He said he believed this was no more than a deliberate and unmitigated cover–up by the Deputy Commissioner, Donal Ó Cualáin. !!
He said he believed that the investigation was similar to the internal Garda investigations into Garda misconduct in Donegal in the 1990s.!!
He went on to say that the protection offered to him as a whistleblower under the terms of the protected disclosures legislation was completely disregarded and ignored by the Garda Commissioner, Nóirín O’Sullivan.” !!
Two years prior to Mr Wallace’s statement to the Dáil, then Independent TD Luke ‘Ming’ Flanagan spoke of Garda Nicky Keogh’s allegations in the Dáil, on May 8, 2014, saying: !!
“His allegations are serious, including a cover up of an original file which was stolen, with the original incident being removed from the PULSE system; the creation of new statements and appearance of new original information; non-compliance by the Garda with the court order for disclosure and at least one of the accused being threatened by a garda to plead guilty on the day of the court case.” !!
“[Garda Nick Keogh]’s greatest concern with the drugs operation in November 2009 is that there was a systematic and orchestrated effort by high-ranking Garda officers to induce and coerce citizens, in this case citizens with no previous criminal conviction, to buy drugs from drug dealers, putting them in personal danger, and sell the drugs in turn to undercover gardaí without making any profit, thus boosting crime detection figures concerning arrests, charges and convictions. The result of this operation was that these mostly young citizens of the State, who had no previous drug convictions, now have serious drug convictions.” !!
“Finally, a further aspect of grave concern regarding the planning of this operation was that the list of persons nominated to be targeted had a notable omission in that a significant and well recognised drug dealer in the area who has long been associated with a senior member of the drugs unit was excluded.”!!
On October 2, 2016, John Mooney, in The Sunday Times, reported that an internal investigation into Garda Nicky Keogh’s complaints of Garda collusion in heroin dealing in the Midlands had “found evidence to substantiate claims” made by Mr Keogh but that the DPP advised there was “insufficient evidence to prosecute those implicated”. !!
Broadsheet understands no report on this internal investigation has been published to date. !!
Readers will recall how the report into the O’Higgins Commission of Investigation didn’t mention certain events which took place during the private commission.

After the report was published, Michael Clifford, of the Irish Examiner, and Katie Hannon, of RTE’s Prime Time, reported that Colm Smyth, the senior counsel for the Garda Commissioner Noirin O’Sullivan, set out in the early stages of the commission that evidence would be produced to show that Sgt McCabe had told two other gardaí that he was making his complaints out of malice. !!
But a few days after this submission, Sgt McCabe told Judge Kevin O’Higgins he had a tape recording of the meeting in question.

The matter was subsequently dropped when the recording proved the allegation to be wrong.!!
In addition, readers may also wish to note that Broadsheet reported last week that, in regards to the wrongful allegation of malice, An Garda Siochana also claimed the reason Sgt McCabe was supposedly acting out of malice was because he wanted the DPP’s directions against him, in respect of Ms D’s 2006 allegation of “humping” – a matter which is part of the current Disclosures Tribunal – overturned.!!
It’s understood An Garda Siochana made this allegation on the belief that Sgt McCabe didn’t know the DPP’s directions. !!
However, it was also dropped when Sgt McCabe informed Judge O’Higgins that he had full knowledge of the DPP’s directions and was very satisfied with them. !!

Letter claims garda kept in dark over allegations probe !!

A Garda who has alleged major criminal wrongdoing within the force has urgently sought clarification on how his allegations have been investigated, RTÉ has learned. !! 

According to correspondence seen by RTÉ’s This Week radio programme, Garda Nick Keogh has written to Garda Headquarters, saying he is totally in the dark over how several related probes into his allegations are now being handled. !!
Garda Keogh first alleged in May 2014 that a garda detective was colluding with a drug dealer to supply narcotics into the midlands region. !!
Garda Keogh, who is a decorated officer, raised this with senior management. Since then, he claims that he was subject to bullying and harassment, and that his career has been effectively derailed. !!
Among the long list of investigations and reports, the conclusions of which he says have been denied to him, include his substantive allegation of criminality. !!
It was subsequently referred to the Garda Síochána Ombudsman Commission (GSOC) and since then he has had no clarity on what that probe found. !!
Secondly, in 2015, he complained that a related investigation which examined this alleged criminality was not properly carried out. !!
Assistant Commissioner Jack Nolan was appointed to head that inquiry up but since Mr Nolan retired earlier this year, Garda Keogh now has no idea who is in charge of that procedure, or if it is even ongoing, he says in his correspondence. !!
Speaking to RTE’s This Week, Carrick-On-Shannon based solicitor John Gerard Cullen, who represents Garda Keogh, said that his client had no idea what was the current status of this complaint. !!
“We don’t know whether it has been mislaid or lost. We don’t have any timeframes. We don’t have any reasons why it’s being treated in this way or that way. We don’t have any excuses for the delay,” said Mr Cullen. !!
“No reasons have been adduced why we might have rational confidence, in circumstances where the delay will obviously prejudice the preservation of documents, and electronic evidence and it’s self evident that justice delayed is justice denied.” !!
Garda Keogh also outlines in the letter that on 27 March of this year, he then made a complaint of bullying and harassment in which he says he was singled out and subject to mistreatment after he brought the original complaint to senior management. !!
He says in the letter that the bullying complaint relates in part to a senior officer in the force who has sought promotion, and he has questioned whether the Policing Authority would have been made aware of this complaint. !!
On the bullying and harassment complaint, Mr Cullen said: “Garda Keogh invoked a formal procedure about six months ago, and we don’t have any idea what has happened since then”. !!
Finally, Garda Keogh also raised questions over a report requested by the former Justice Minister Frances Fitzgerald, and carried out by Garda HQ, into Garda Kehoe’s treatment. !!
“I think it was in October 2016, which would now make it almost a year, that the Commissioner advised us she was seeking an urgent report. !!
“Other than giving a very unusual sense to the word urgent, whereby one is left waiting for an answer for almost a year, nothing is known about the content of that investigation. The only thing we have been advised is that it has gone to GSOC,” Mr Cullen said. !!
“Again the whole matter is inscrutable. We have no idea what’s in that urgent report,” the solicitor said. !!
Mr Cullen said that they had been denied even a redacted version of the report.

The Garda Press office said that as administrative offices were closed over the weekend, it was not possible for them to provide any detailed response to a series of questions from RTÉ, into the nature of the reports and investigations sought by Garda Keogh !!
