Garda commission chair says ‘no one person’ will reform the force !! 
Kathleen O’Toole, the chairman of the Commission on the Future of Policing in Ireland, has said she believes Garda reform will not be achieved by one person. !!
Ms O’Toole, who was Boston’s first female police commissioner, told The Irish Times that reform within An Garda Síochána required a “sophisticated” and “cohesive” management team. !!
Ms O’Toole also said it was her hope that the Commission on the Future of Policing in Ireland could provide the “framework” and “direction” for the new Garda Commissioner and their management team. !!
“No one person is going to reform an organisation of this size. It requires a very sophisticated and cohesive management team, but we are working on creating that model that will serve the organisation well and the community over the long haul,” she said on Tuesday. !! 
Ms O’Toole said it didn’t matter where the new commissioner comes from as long as they are the “best candidate”. !¡
“I think, in the end, it is going to be the work of the Policing Authority to develop the job specifications. The Policing Authority will work with Government to what that job specification should look like going forward and all the details surrounding that. !!
“At this point it just needs to be the best candidate and person, whether that be someone from this island or elsewhere, but as I said before success will not result from one person. !!
“The only reason I have had success in different roles in my career was because I surrounded myself with great people and we worked cohesively as a management team and that will be required here too,” she told The Irish Times. !!
The Commission on the Future of Policing in Ireland was established to examine the structure of An Garda Síochána, as well as its culture and ethos, recruitment, training and management. !!
Ms O’Toole was speaking amid several controversies involving the force, including escalating tensions between Garda management and rank-and-file members over where the blame lies for the falsification of 1.5 million breath tests. !!
The Garda Representative Association, which represents lower-ranked gardaí, has claimed senior and middle Garda management are to blame for the scandal, a claim rejected by the Association of Garda Sergeants and Inspectors. !!
The force is also dealing with the fallout from the resignation of former commissioner Nóirín O’Sullivan and a recent finding by the Policing Authority that 50 reform initiatives which senior officers claimed had been completed had only been finalised in nine cases. !!
‘Ambitious agenda’

Ms O’Toole, who was also a member of the Independent Commission on Policing for Northern Ireland, also known as the Patten Commission, which was established in 1998 as part of the Belfast Agreement, said that she and her commission colleagues were currently working on an “ambitious agenda”. !!
“Obviously we have a very ambitious agenda, we have to report out by next September. We have no intention of producing documents with hundreds of recommendations, we are looking at five or six categories that we think will help transform and modernise the organisation. !!
“We have divided up among us and we have an extremely impressive group of people which I’m honoured to be among . . . really, extraordinary experience and a diverse group. There are only a few of us who have spent our career in policing, myself and [former chief constable of Greater Manchester Police] Peter Fahy, and similar to the Patten experience in Northern Ireland, we were able to get a really diverse group with different views and in the end will produce a valuable report,” she said. !!
Ms O’Toole said she would continue to value the “feedback” of former Garda ombudsman Conor Brady, who announced his resignation at the weekend from the Commission on the Future of Policing in Ireland. !!

As a citizen I am extremely concerned by the fact that commissioner O’Sullivan is dictating & interfering with the Tribunal inquiry… the state provide an independent & impartial judicial system under Art 34 – 35 & 36 of the Constitution… As a Judge of the Supreme Court, you have an obligation to compel O’Sullivan to step aside during the tribunal inquiry… 
It is an obvious fact that she has a full intention to flaw the inquiry by appointing retired Gardai & by putting Mr Tailor under investigation again… ‘’ The ring of steel ‘’ described in the press to cover up massive cases of corruption speak for itself The people who abide to the Constitution demand that O’Sullivan is removed from office during the inquiry. it is an absolute scandal & beyond belief that she is under investigation & able to control facts & evidences by staying in charge of the force… It’s like a person under criminal investigation dictating on which grounds his or her investigation must take place…
I did send a file to the Tribunal in regard of my case…

How can this tribunal can be independent & impartial while O’Sullivan is in charge of who is going to say what & which documents & evidences will or will not be forwarded to the Tribunal ??????????????????? she is already interfering with Mr Tailor by placing him under investigation albeit he has been cleared by the DPP.
The Government indicate that the commissioner is entitle to due process & so we do . In your opening speech, you indicate that ‘’ if a person has a problem, that person should first of all apply to the tribunal in a genuine manner. ‘’ ‘’ the inquiry cannot be a waste of what ordinary men & women have paid for.’’….
I AND THE ABIDING LAW CITIZENS DEMAND THAT THE TRIBUNAL TAKE IMMEDIATE STEPS TO ENSURE DUE PROCESS BY REMOVING O’SULLIVAN FROM THE FORCE DURING THE INDEPENDENT & IMPARTIAL INQUIRY… 

Section 1 (d) of the ECHR refer to… ‘’ organ of the State ‘’ include a tribunal… So the tribunal has an obligation to remove O’Sullivan of the force to insure due process of law…
The tribunal is empowered under The Garda Siochàna Act 2005 section 12 (3) e to order the commissioner to step aside to insure due process of law.

Garda Headquarters have identified text messages sent and received by former garda press officer Dave Taylor to a number of officers, which said that a journalist had interviewed a woman who made an abuse allegation against Sgt Maurice McCabe…..
It had been thought Taylor texted only Nóirín O’Sullivan about the issue but an analysis of phone data has discovered that several other senior officers received similar messages……
Records of the texts and call logs are to be passed to the Charleton tribunal, which is investigating whether there was a conspiracy among gardai to smear McCabe in 2014 after he exposed abuse of the penalty points system and raised concerns about policing in Cavan/Monaghan…..
Among those who received similar texts about McCabe was Martin Callinan, the garda commissioner at the time, who has since retired……
An analysis of messages found on mobile phones used by Taylor has uncovered ongoing communications among a small group of senior gardai relating to O’Sullivan, her promotion to commissioner, Callinan’s resignation, and allegations made by McCabe…..
A large volume of texts was exchanged after O’Sullivan transferred Taylor out of the garda press office in May 2014 for allegedly disclosing private correspondence between Callinan and the Department of Justice. Some texts are said to contain vulgar comments about O’Sullivan, while others described garda officials as “rats”……
The frequency of the texts appeared to change following Taylor’s arrest in 2015 on suspicion of disclosing information to journalists following his departure from the garda press office. Security sources suspect the officers involved began to use unregistered mobile phones to communicate with each other, as they suspected force management might have become aware of the earlier texts once they seized Taylor’s phones as part of an internal inquiry…..
Some officers, including Callinan, appear to have ceased communicating with Taylor following his arrest and suspension from the force…..
According to security sources, the contents of the text messages indicate that O’Sullivan’s promotion provoked bitterness among some ­colleagues, who appear to have either disliked her style or resented decisions she made…….
Taylor has denied having any agenda against O’Sullivan and maintains he decided to reveal details of his own role in smearing McCabe out of remorse…….
One of the central allegations made by Taylor is that he sent a text message to O’Sullivan, then deputy commissioner, to say Paul Williams, a special correspondent with the Irish Independent, had interviewed a woman who made a sexual abuse allegation about McCabe. The director of public prosecutions had already decided not to prosecute as no offence was disclosed…….
Taylor claims O’Sullivan responded to his text with a one-word reply: “perfect”. O’Sullivan maintains she received a large number of messages from Taylor because she had instructed him to alert her to the publication of any story which could have an impact on the force. The instruction was contained in a circular dated November 2013……
O’Sullivan has also claimed she used the word “perfect” or “thanks” as a “perfunctory” reply to the large number of messages she received as deputy commissioner and was unaware of Taylor’s activities to tarnish McCabe before he admitted to doing so in a protected disclosure……
The commissioner previously denied being aware of any smear campaign against McCabe when she appeared before an Oireachtas committee. She has resisted calls from opposition politicians to stand aside until the Charleton tribunal completes its work. The government has endorsed her position……
Security sources believe O’Sullivan will allege that she herself was the subject of a whispering campaign by some colleagues when she appears before the Supreme Court judge Peter Charleton……
McCabe and his family are suing the HSE and Tusla over the false allegations of child sex abuse made against him……
McCabe, his wife, Lorraine, and their three children issued proceedings last Wednesday for malicious falsehood, negligence and emotional suffering, as well as for breaches of their constitutional rights under privacy and data protection legislation……
This followed the discovery that Tusla, the child and family agency, sent a file containing the allegations to gardai in 2013……

Five weeks ago the Tánaiste referred two very serious protected disclosures by two senior gardaí to a retired judge, Mr. Justice Iarfhlaith O’Neill, for urgent inquiry. !! 
The disclosures, in which it was alleged the Garda Commissioner, Ms Nóirín O’Sullivan, was directly involved in a systematic and organised campaign to discredit the whistleblower Sergeant Maurice McCabe with colleagues, politicians and journalists, were due to be investigated by the former judge, who is due to conclude and report back next week. !! 
However, he was given no powers of compellability and no terms of reference. Attempts made by other whistleblowers to have their cases heard also, as they too have been the victims of bullying and harassment since making protected disclosures, were ignored, despite the fact that their testimony and experiences were current. !!
They go to the very heart of the systemic problem in An Garda Síochána – what is said in public and what is done privately are entirely different. It was hardly an auspicious start to the inquiry when this was its foundation. !! 
One would be forgiven for thinking it was put together as a fig leaf for the Minister to take cover behind for her lack of action in this regard. !! 
This view has been strengthened as we find out that with a week to go to the issuing of his report, the former judge has not requested any material from either of the two whistleblowers. !! 
He has not met or even spoken to either man. In fact, the only interaction was request, approximately two weeks ago, to their legal teams to pass on the protected disclosure to the Garda Commissioner. !! 
We could not make it up. !! 
What sort of inquiry does the Minister honestly expect us to believe this is? While this has been going on, we have had the GardaCommissioner appear at the justice committee with senior officers who are at the heart of many of the protected disclosure complaints. !! 
At the same meeting she misled the committee by stating she was not privy to information on a campaign of harassment against any member of the force when she was actually in direct receipt of 14 letters outlining precisely the situation. !! 
She has been the subject of a detailed section 41 complaint on which the Minister has been briefed. We are awaiting GSOC’s finding. !! 
She has lost the support of the ranks of the force by intervening in a partisan way in their legitimate pay claim with threats of martial law. !! 
Why has the Tánaiste allowed the situation to continue to crisis point? On what basis does she believe she has the right to delegate to retired judges, GSOC and the courts functions that are her responsibility in law, namely, to hold the Commissioner to account?

I would have thought the Court of Appeal’s ruling today would have been an intense reminder to Members that we should take stock and reflect before making allegations in the House. The good name and reputation of all individuals deserve respect and fair procedures. !! 
The Deputy is making various points about a report a judge is currently conducting and which is due next week. She has stated she has access to details of it. I do not. !! 
It is an independent report by a judge. As the House is aware, I appointed Mr. Justice Iarfhlaith O’Neill to review allegations of wrongdoing set out in some protected disclosures made to me. !! 
In addition to reviewing the allegations, Mr. Justice O’Neill has been asked to report on his conclusions, in a preliminary report, and make any recommendation he considers necessary on further action deemed to be appropriate or warranted. !! 
The report and review have been commenced and the judge was asked to report within six weeks. He will report next week and I have no reason to believe this deadline will not be met. !! 
As soon as I receive the report, I will consider it very carefully and examine the recommendations made. !! 
The Government will decide on future action to be taken on the points made by the Deputy. !! 
I asked Mr. Justice O’Neill to conduct this review because I was very concerned, as I have stated in the House previously, about the content of the material I had received. That is why I decided this should be done. !! 
The Garda Commissioner has indicated publicly that the GardaSíochána will co-operate fully with any examination of these matters. !! 
How the judge conducts his business during these six weeks is a matter for him. I will get the report, I will examine it and I will decide on action relating to the issues he has examined. It was thought that, as a first assessment, it would be extremely useful to ask a judge to examine the material that was given to me. !! 
If for any reason, he has concerns about the level of co-operation I have no doubt he will make them very clear. I will read his report with great interest when I receive it next week. !!

It is my desire to ensure that every leader has an opportunity to raise matters of important public concern and Deputy Daly is doing that. !! 
However, we have absolute privilege and we should be very careful how we use that absolute privilege. It has been a long-standing precedent that we do not make allegations against people outside the House. !! 
The Deputy referred to protected disclosures and they are certainly in the public media but she has made specific allegations about a committee being misled by the Garda Commissioner. !! 
I think that is inappropriate, it is not something we should do and it is certainly not something the Deputy should now repeat !!

I take my responsibility very seriously in this regard and I repeat, very firmly, that nothing I said was an allegation or a use of privilege. !! 
I gave details of facts which can be supported by evidence and I have no problem standing over any of those points. !! 
The Tánaiste made the point that it is up to the judge to carry out the inquiry as he sees fit but he can only do that within the confines of the powers he has. !! 
Can the Tánaiste confirm to the House that the judge has been given the authority to request the electronic information that supports the allegations at the heart of these matters? People’s good names are very important and at the heart of this matter are the muddying and tarnishing of the good name of Sergeant Maurice McCabe. !! 
This is also about the horrendous nightmare that is being experienced by current members of An Garda Síochána who have made protective disclosures and I am not only talking about those whose names are in the public domain. !! 
I and Deputy Wallace recently met with a further six serving members of An Garda Síochána who have all either made protective disclosures or are on the verge of doing so. What part of this situation does the Tánaiste think is normal or okay? We have an enormous crisis of confidence inside An GardaSíochána, primarily and largely centred on the role of the GardaCommissioner. !! 
The civilian head of An Garda Síochána, GSOC and the courts are investigating these matters but the Tánaiste seems to be okay with delegating to others her legal responsibility for doing precisely that and she will not get away with it. !!

I have made sure that if allegations arrive on my desk they are appropriately handled. !! 
I want to ensure that whistleblowers feel a confidence in coming forward and every action I have taken has been targeted at ensuring that whistleblowers in An Garda Síochána are dealt with appropriately and properly. !! 
The actions of the Garda Commissioner in working with Transparency Ireland and in implementing the new policy have been to ensure that whistleblowers feel supported if they come forward. !! 
Many challenges are facing An Garda Síochána and this and the last Government have taken steps to ensure bodies exist with independent responsibility to monitor, assess and discuss with An Garda Síochána the various issues which arise. That is why we set up an independent Garda authority, the first time we have ever had an independent authority responsible for oversight of the work of An Garda Síochána. !! 
Members of this House have consistently called for independent bodies to monitor the work of gardaí, to take account of the various initiatives in which they are involved and to look at policies and their implementation. !! 
We now have the Policing Authority and GSOC, which is responsible for investigating complaints. I will not take any actions that will cut across the work of the independent bodies that Members of this House sought. !!
